1. Acceptance of Terms

Welcome to aerii ("aerii," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website aerii.co (the "Site"), and any purchase you make through it. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms in full. If you do not agree to these Terms, please do not use the Site.

We may update these Terms from time to time as our business, product range, or applicable law changes. The version posted on this page at the time of your order governs that order.

2. About Us

aerii is operated as an individual business based in Hong Kong. We design and sell fashion jewellery, primarily gold-plated earrings. For any questions about these Terms or your order, please contact us through our Contact page.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that is older, to place an order with us. By placing an order, you confirm that you meet this requirement. If you are ordering on behalf of a company or other organisation, you confirm that you have the authority to bind that entity to these Terms.

4. Products

4.1 We make reasonable efforts to display product colours, dimensions, and materials accurately. Slight variation may occur due to photography, screen display settings, lighting, or the handmade nature of some pieces.

4.2 Unless otherwise stated, jewellery listed on the Site is 18k gold-plated on a brass base. Gold plating is a layer of gold applied over a base metal. Gold plating will naturally wear, fade, or tarnish over time with normal contact, moisture, perfume, lotion, and friction — this is expected wear and is not considered a manufacturing defect.

4.3 We reserve the right to limit quantities, discontinue any product, or correct pricing or description errors at any time, including after an order has been placed. Where this affects a confirmed order, we will notify you and offer a full refund or a suitable alternative.

5. Pricing and Currency

5.1 Prices are displayed in the local currency associated with your selected market, which may include HKD, CNY, MOP, SGD, TWD, AUD, or NZD depending on your location.

5.2 Prices are subject to change without notice. A price change made after you have placed and received confirmation of an order does not affect that order.

5.3 We make reasonable efforts to ensure pricing is accurate. If a pricing error occurs, we reserve the right to cancel the affected order and issue a full refund, even if the order has been confirmed.

6. Orders

6.1 Placing an order through the Site is an offer to purchase, which we may accept or decline at our discretion.

6.2 You will receive an order confirmation once your order is accepted. This confirmation does not guarantee stock availability in the event of an error.

6.3 We reserve the right to decline, limit, or cancel any order, including for reasons such as stock unavailability, suspected fraudulent activity, pricing or listing errors, or where we are unable to verify your information. Where we cancel a paid order, a full refund will be issued.

7. Payment

7.1 Payment is due in full at the time of ordering, processed securely through our payment provider at checkout.

7.2 We do not store your full payment card details. Payment processing is handled by our third-party payment processor in accordance with their own security and privacy practices.

8. Shipping and Delivery

8.1 Shipping rates, delivery estimates, and coverage by destination are set out in our Shipping Policy, which forms part of these Terms.

8.2 Delivery timeframes provided at checkout or on our Shipping Policy are estimates only and are not guaranteed. We are not responsible for delays caused by the courier, customs processing, incorrect address details provided by you, or events outside our reasonable control.

8.3 Risk in the goods passes to you upon delivery to the shipping address provided, except where local law provides otherwise.

9. Customs Duties and Import Taxes

9.1 Depending on your destination, applicable customs duties and import taxes may be calculated and charged at checkout, or may instead be assessed and collected by the courier prior to delivery. Details by destination are set out in our Shipping Policy.

9.2 Where duties or taxes are not collected at checkout, they remain your responsibility as the importer of record, and the courier may contact you directly to arrange payment before delivery is completed.

9.3 aerii is not responsible for delays, additional charges, or customs holds arising from the customs clearance process in your destination country.

10. Returns, Exchanges, and Refunds

10.1 Due to hygiene standards applicable to pierced jewellery, returns and exchanges are accepted only where an item has a manufacturing defect. Outside of this, all earring sales are final.

10.2 To report a defect, contact us within 7 days of delivery with supporting evidence (such as photos or video). Approved returns must be unworn and in their original condition.

10.3 Taiwan: In accordance with Taiwan's Consumer Protection Act, close-fitting items such as jewellery (earrings, ear studs, necklaces, rings, bracelets, etc.) are classified as personal hygiene products. Once sold, there is no cooling-off period, and in accordance with personal hygiene principles, returns, refunds, or exchanges will not be accepted.

10.4 This policy applies uniformly to all customers regardless of location. Nothing in this section is intended to override any statutory right that cannot be excluded under the mandatory law of your jurisdiction — see Section 15.

11. Intellectual Property

All content on the Site — including text, images, logos, graphics, and design — is owned by or licensed to aerii and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.

12. Prohibited Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorised access to the Site, its systems, or other users' accounts; (c) interfere with or disrupt the operation of the Site; (d) use bots, scrapers, or other automated means to access or extract data from the Site without our permission; or (e) impersonate any person or misrepresent your affiliation with any person or entity.

13. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, except where such warranties cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by law, aerii shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it. Our total liability for any claim arising from your order shall not exceed the amount you paid for the product giving rise to the claim.

15. Your Statutory Rights

Nothing in these Terms excludes, limits, or attempts to override any right you have under mandatory consumer protection law in your country of residence that cannot lawfully be excluded by agreement. Where a provision of these Terms conflicts with such a mandatory right, the mandatory right prevails to the extent of that conflict.

16. Indemnification

You agree to defend, indemnify, and hold aerii harmless, including our officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) your breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

17. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong.

18. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, labour disputes, or disruptions to shipping or courier networks.

19. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Shipping Policy and Privacy Policy, constitute the entire agreement between you and aerii regarding your use of the Site, and supersede any prior agreements or understandings.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
